Litigation Lab Community – Data Processing and Confidentiality Addendum

Effective Date: April 28, 2026

This Data Processing and Confidentiality Addendum ("Addendum") forms part of the Terms of Use and applies to all law firms, attorneys, experts, consultants, and other professional participants ("Participants") using the platform.

1. Purpose

This Addendum governs the handling, use, and protection of information accessed through Litigation Lab Community in connection with legal matters, claims, and professional opportunities.

2. Nature of Information

Participants acknowledge that information available through the platform may include:

  • Sensitive personal or business information
  • Preliminary or developing legal matter details
  • Non-public professional communications

Such information may or may not be subject to attorney–client privilege.

3. Confidentiality Obligations

Participants agree to:

  • Treat all non-public information as confidential
  • Use such information solely for evaluating, developing, or participating in matters and opportunities within the platform
  • Limit access to authorized personnel within their organization on a need-to-know basis

Participants shall not:

  • Disclose information to unauthorized third parties
  • Use information for competitive, commercial, or unrelated purposes
  • Retain or reuse information outside the scope of legitimate engagement

4. Data Handling Standards

Participants agree to implement reasonable administrative, technical, and organizational safeguards to protect information accessed through the platform, including:

  • Secure storage and transmission practices
  • Access controls within their organization
  • Protection against unauthorized access or disclosure

5. No Guarantee of Privilege

Participants acknowledge:

  • Litigation Lab Community does not establish or guarantee attorney–client privilege
  • Determining whether information is privileged is the responsibility of the Participant
  • Participants should exercise discretion when sharing or receiving sensitive information

6. Use Limitation

Information obtained through the platform may only be used for:

  • Evaluating potential engagement
  • Participating in matters or opportunities
  • Professional collaboration within the ecosystem

Use for unrelated purposes is strictly prohibited.

7. Retention and Deletion

Participants agree to:

  • Retain information only as long as necessary for legitimate purposes
  • Delete or securely dispose of information when no longer needed
  • Comply with applicable legal and professional obligations regarding data retention

8. Breach Notification

Participants agree to promptly notify Litigation Lab Community if they become aware of:

  • Unauthorized access to information
  • Disclosure or misuse of information
  • Any security incident affecting data obtained through the platform

9. Cross-Border Data

Participants acknowledge that information may be transferred across jurisdictions, including between Canada and the United States, and agree to comply with applicable data protection laws.

10. Survival

These obligations survive termination of access to the platform.


By using the platform, Participants agree to comply with this Addendum.
